Terms of Service

1. About these terms

These terms cover Last Stand (the game and its official game servers), the website at laststandgame.xyz and your Last Stand account, and Last Stand Bot (our Discord bot). Together we call these "the Services". They're made and run by Koaxy, an independent developer in the United Kingdom ("we", "us").

By playing, making an account, or using the bot, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Services.

2. Who can use the Services

You must be at least 13, or the minimum age for using Discord where you live if that's higher. If you're under 18, check with a parent or guardian first.

3. Your account

• You're responsible for your account and for keeping your password safe. Don't share your account, and don't sell, trade or give it away.
• Your account name is public. It mustn't be offensive, hateful or sexual, or pretend to be someone else (including us or staff). We may change a name that breaks this rule.
• If you think someone else has got into your account, change your password and sign out everywhere from your account page, and tell us.

4. Playing fair

When you use the Services, you must not:

• cheat: use hacks, aimbots, speed or teleport tools, modified game files, or anything that gives you an unfair advantage or fakes your stats, leaderboard places or achievements;
• deliberately use bugs or exploits to get ahead. If you find one, please report it instead;
• harass, threaten, bully or abuse other players, or post hateful, sexual or illegal content, in game chat, names, tickets, suggestions or anywhere else;
• spam, advertise, or impersonate other people;
• try to break into, overload, disrupt or attack our servers, website, database or bot, or get around bans or security measures;
• reverse-engineer or tamper with the game's anti-cheat or its connection to our servers, except as the law allows.

Our servers check for cheating automatically. Admins and moderators can also kick, mute or ban players.

5. Bans and suspensions

If you break these terms, we may warn you, remove your stats or achievements, take you off the leaderboards, or suspend or ban your account, your access to our servers, or your IP address, temporarily or permanently. Where we reasonably can, we'll tell you why. If you think a ban was a mistake, contact us (see section 13) and we'll look at it again.

6. Last Stand Bot in your Discord server

If you add the bot to a Discord server or set it up as staff:

• you need the right permissions in that server to add and configure it;
• you're responsible for how your server uses it, including moderation actions taken through it, and for following Discord's Terms of Service and Community Guidelines;
• you must not use the bot to harass people, collect members' data for other purposes, spam, or do anything illegal;
• you should let your members know the bot is there and what it does (for example, that it reads messages for automod and XP), and point them to our Privacy Policy.

We may remove the bot from a server, or limit what it does there, if it's being misused.

7. What you post

You keep ownership of what you post through the Services, such as your name, chat messages, suggestions and tickets. You give us permission to store it, show it to other users and use it as needed to run the Services. We may remove anything that breaks these terms.

8. Our game and content

Last Stand, its code, design, logo and website are ours. Some art, models, animations and sounds are made by others and used under their licences. We give you a personal, non-exclusive, revocable permission to download and play the game and use the Services for your own non-commercial use. You may share videos, streams and screenshots of the game. You may not sell or redistribute the game or its files without our permission.

9. Updates and availability

Last Stand is free and in active development. We update the game regularly (it updates itself), and we may change, add or remove features, maps, items, balance and stats. Servers may sometimes be offline for updates, maintenance or problems, and we may stop running some or all of the Services at any time. Where we can, we'll give notice in the Last Stand Discord server.

10. No guarantees

The Services are provided "as is" and "as available". As far as the law allows, we don't promise that they'll be uninterrupted, error-free, or that progress, stats or data will never be lost.

11. Limits on our liability

As far as the law allows, we're not liable for any indirect or consequential loss, or for loss of data, progress or in-game items, arising from your use of the Services. Because the Services are free, our total liability to you for anything else is limited to £50. Nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud, and nothing affects your statutory rights as a consumer.

12. Changes to these terms

We may update these terms. We'll change the date at the top and, for significant changes, announce them in the Last Stand Discord server or in the game. If you keep using the Services after a change, you accept the new terms.

13. Contact, ending, and the law

You can stop using the Services at any time and ask us to delete your account (see our Privacy Policy). We may suspend or end your access if you break these terms.

These terms are governed by the law of England and Wales, and its courts have jurisdiction. If you live elsewhere in the UK or the EU, you keep any protections your local consumer law gives you, and can bring a claim in your local courts.
